By accessing or using the Gardner Fish & Gun Club member portal ("the Platform"), submitting a membership application, or creating an account, you ("Member" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use this Platform.

Use of the Platform and membership in the Club requires that you be at least 18 years of age and legally capable of entering into binding agreements. By using the Platform, you represent that you meet these requirements.

• Members must abide by all Club bylaws, rules, and regulations as adopted by the Board of Directors.
• Members are responsible for keeping their contact and payment information current.
• Annual dues must be paid to maintain active membership status.
• Range access requires completion of the Club's range safety course or documented grandfathering.
• Members are responsible for the conduct of any guests they bring onto Club property.
• Membership is non-transferable and may be suspended or revoked for violations of Club rules.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify the Club immediately if you suspect unauthorized access to your account. The Club is not liable for losses resulting from unauthorized account use.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Platform or other accounts
• Submit false, misleading, or fraudulent information
• Harass, threaten, or abuse other members or Club staff
• Interfere with or disrupt the Platform's operation or servers
• Scrape, harvest, or collect data about other members without authorization
• Send unauthorized bulk messages to members or staff through any platform channel
• Misuse, export, or redistribute member phone numbers or contact information obtained through the Platform
• Attempt to access, copy, or extract member phone data or SMS consent records without authorization

Gardner Fish & Gun Club SMS Notifications Program

By providing your phone number and explicitly opting in via an unchecked consent checkbox, you consent to receive recurring text messages from the Gardner Fish & Gun Club related to:

• Membership updates and status changes
• Dues reminders and payment confirmations
• Range status alerts and closures
• Event notifications and reminders
• Facility booking and rental updates
• Employee scheduling notifications
• Operational announcements
• Emergency club communications

Message frequency varies based on member activity, notification preferences, club operations, and events. You may receive recurring automated or manual SMS messages. Message and data rates may apply depending on your mobile carrier and plan.

To opt out, reply STOP to any message at any time. You will receive one final confirmation and no further SMS messages will be sent. You may also revoke consent at any time by updating your notification preferences within the Member Dashboard.

Reply HELP to any message for assistance. You will receive Club contact information and additional support instructions. You may also contact the Club at (978) 632-9774 or P.O. Box 396, Gardner, MA 01440.

Consent to receive SMS messages is not a condition of membership, application approval, any purchase, rental, or Club service. Users may use the full Platform and maintain active membership without consenting to SMS communications.

Mobile opt-in data, SMS consent records, and phone numbers collected for SMS communications will not be shared, sold, rented, or disclosed to third parties or affiliates for marketing or promotional purposes.

The Club maintains records of SMS consent, opt-in actions, opt-out requests, and communication preference changes for compliance and operational purposes.

The Club will also send email communications related to your membership, dues, and club activities. You may update your communication preferences at any time through the Member Dashboard.

Membership dues and fees are processed via Stripe. Application fees and initiation fees are generally non-refundable unless the application is denied by the Board of Directors. Annual dues are non-refundable once the membership year has commenced. Facility rental deposits and payments are subject to the specific terms of the rental agreement.

Use of Club facilities is subject to Club rules and any applicable reservations or fee schedules. Members assume responsibility for their own safety and the safety of their guests while on Club property. The Club is not liable for injuries, losses, or damages arising from the use of Club facilities except where required by law.

All content on the Platform, including text, graphics, logos, and software, is the property of the Gardner Fish & Gun Club or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. The Club does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, the Gardner Fish & Gun Club, its officers, directors, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform or your membership, even if advised of the possibility of such damages. Our total liability shall not exceed the amount of dues paid by you in the preceding 12-month period.

The Club reserves the right to suspend or terminate your account or membership at any time for violation of these Terms, Club bylaws, or any applicable laws, subject to the Club's established disciplinary procedures. You may request account deactivation by contacting Club administration.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Worcester County, Massachusetts.

We reserve the right to modify these Terms at any time. We will notify active members of material changes via email at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
